A legal battle is brewing at the University of Ghana as the General Assembly Representative for the Graduate Students Association of Ghana, Joshua Nii Tackie Essel, seeks to halt the newly constituted Student Representative Council (SRC) audit board.
Essel claims that the board does not meet the requirements for its formation and that the procedural motion used to approve the board was unconstitutional.
According to a statement of case filed on May 4th, 2023, Essel is seeking an interlocutory injunction on the new audit board and has appealed to the court to prevent the board from performing its functions. The plaintiff is calling on the judicial board to take immediate action to ensure that the constitution of the audit board is halted until the matter is resolved.
In the statement of case, Essel argues that the new audit board was not properly constituted and that it does not meet the requirements set out in the SRC constitution. He also claims that the procedural motion used to approve the board was unconstitutional and violated the rights of the students. The plaintiff contends that the board’s formation is in breach of the SRC constitution and that it must be halted until the issue is resolved.
Essel is seeking several reliefs in the suit, including an order of the court directing the SRC to comply with the provisions of its constitution and the laws governing the establishment of the audit board. He is also asking for an order restraining the SRC and the newly constituted audit board from performing any functions until the court determines the legality of their formation.
