File civil case for damages from social media scandal – Lawyer advises Serwaa Amihere

Legal Practitioner, Amanda Clinton has advised renowned media personality, Serwaa Amihere to file a civil case against her perpetrators, to collect compensations for damages incurred in releasing her explicit video on social media.

Mrs. Clinton made this suggestion following the state’s prosecution of the perpetrators involved in the social media leak scandal involving Serwaa Amihere.

The perpetrators, including Henri Amponsah, known as Henry Fitz, Edem Saviour Ketti, a filmmaker, and Candylove Kwakyewaa Ababio, a trader, were reported to have extorted Ghc 20,000 from the media personality as blackmail in order not to release the explicit video, a deal they failed to uphold when the video was leaked on social media.

Serwaa subsequently reported the incident to the police, who have taken up her case, with the perpetrators to be prosecuted under the offence of the constitution.

In an exclusive interview with Univers News, Lawyer Amanda Clinton suggested that Serwaa files a civil case against the perpetrators during or after their  to gain settlements from damages the leak may have caused to her reputation as a high profile personality.

According to the lawyer, the media personality may have incurred loss of ambassadorial deals and other forms of deals due to the leak, and would need compensation as such.

“So, [Serwaa] can file her case to the civil court, the high court, be it after or during the criminal case.”

“Since she’s a high profile person, who built her reputation, she can say that [the scandal] has cost her a certain amount in terms of revenue for any endorsement she lost, and then her lawyer can quantify the damage based on her reputation’s worth.”

Mrs. Clinton also advised Serwaa to seek an injunction against Henry Fitz to prevent him from staining her personality any further as well as protecting her entourage.

“Her lawyer should look at seeking an injunction to stop him from talking [or posting on the scandal] until the judge decides on this matter.”

Meanwhile, one of the perpetrators, Edem Ketti has been arrested, with efforts being made to arrest Henry Fitz for charges of four counts related to conspiracy to share intimate images, non-consensual sharing of intimate images, and sexual extortion. These acts contradict Section 23(1) of the Criminal Offences Act 1960 (Act 29), as well as Section 67(1)(2) of the Cybersecurity Act 2020 (Act 1038).
