UG: SRC Judicial Body places interlocutory injunction on Audit Board

The Judicial Board of the University of Ghana’s Student Representative Council has placed an interlocutory injunction on the Council’s Audit Board.

This follows a petition for an order of injunction on the audit board by the General Assembly Representative for Graduate Students Association of Ghana in University of Ghana, Joshua Nii Tackie Essel.

The petition, which was submitted to the UGSRC Judicial Board earlier on 4th May, 2023, explained that the formation of the audit board was unconstitutional.

Essel argued that the new audit board was not properly constituted and that it did not meet the requirements set out in the SRC constitution. He claimed that the procedural motion used to approve the board was unconstitutional, violating the rights of the students.

The plaintiff contended that the board’s formation is in breach of the SRC constitution and that it must be halted until the issue is resolved.

In a letter signed by the Chief Justice of the UGSRC Judicial Board Kwabena Addae-Marfo on 9th June, 2023, an interlocutory injunction was placed on the Council’s Audit Board in response to the plaintiff’s petition.

The order halts all activities of the audit board and its members until the court determines its legality.

“And upon hearing the submissions of Counsel for and on behalf of the Applicant and the Respondent respectively: It is hereby ordered that the Audit Board by itself, its officers, members, agents, servants, etc. are restrained from conducting its business pending the determination of the substantive suit.”
