Legal activist and Law Student at the University of Ghana School of Law, has urged the disqualified aspirants in this year’s UGSRC elections to challenge the decision if the Electoral Commission (EC) does not retract its ruling.
The disqualification of Maradona Adjei-Yeboah ‘Guru’ and Lawrence Edinam Egleh, both non-resident students, was based on Article 30 of the UGSRC Constitution, a provision that has reportedly been expunged.
Speaking in a Radio Univers Twitter Space on Friday, the legal activist expressed his concerns about the disqualification, highlighting that the application of a removed constitutional provision is a clear error that needs immediate correction. He emphasized that the EC is fully empowered to remedy this mistake, should they acknowledge it.
“Applying a provision that has been expunged to disadvantage some aspirants is clearly not a proper thing to do. It is an error, and the EC has the authority to correct it immediately, especially if the affected candidates have brought it to their attention,” he stated.
He further advised that if the EC does not retract the disqualification, the aspirants should not hesitate to escalate the matter to the UGSRC Judicial Board.
He underscored that the disqualified candidates have a strong case for challenging the decision, given that the provision used to disqualify them no longer exists in the constitution.
“In the event that the EC does not take steps to correct this error, the disqualified aspirants are well within their rights to seek redress through the Judicial Board. They could also petition other university authorities responsible for ensuring that all actions are in line with the law.”
